Tribal Self-Governance Program Negotiation Cooperative Agreement: The purpose of the Negotiation Cooperative Agreement is to provide resources to Tribes interested in participating in the Tribal Self-Governance Program (TSGP), as authorized by Public Law (Pub. L.) 106-260, the Tribal Self-Governance Amendments of 2000, and Title V of the Indian Self-Determination and Education Assistance Act, Pub. L. 93-638, as amended (Title V) (25 U.S.C. § 458aaa-2(e)). The Negotiation Cooperative Agreement provides a Tribe with funds to help cover the expenses involved in preparing for and negotiating a compact and Funding Agreement (FA) with the Indian Health Service (IHS). There is limited competition under this announcement because the authorizing legislation restricts eligibility to Tribes that meet specific criteria (Refer to Section III.1.A., ELIGIBLE APPLICANTS in this announcement). The TSGP is designed to promote Self-Governance by enabling Tribes to assume control of IHS programs, services, functions, and activities (PSFAs), or portions thereof, through compacts negotiated with the IHS. This program is described at 93.444 in the Catalog of Federal Domestic Assistance (CFDA). The Negotiation Cooperative Agreement provides resources to assist Indian Tribes with negotiation activities that include but are not limited to: 1. Determine what PSFAs, or portions therein, will be negotiated. 2. Identification of Tribal funding shares that will be included in the FA. 3. Development of the terms and conditions that will be set forth in the compact and FA.

Additional Information on Eligibility
(A). Be a Federally-recognized Tribe as defined in 25 U.S.C. § 450b(e), (B). Submit a Tribal resolution or other official action from the appropriate governing body of each Indian Tribe to be served authorizing the submission of the Negotiation Cooperative Agreement application. An Indian Tribe that is proposing a Negotiation Cooperative Agreement affecting another Indian Tribe must include resolutions from all affected Tribes to be served and, (C). Demonstrate, for three fiscal years, financial stability and financial management capability, which is defined as no uncorrected significant and material audit exceptions in the required annual audit of the Indian Tribe's Self-Determination contracts or Self-Governance Funding Agreements with any Federal agency.
