Arroyo Canal Fish Screen and Sack Dam Fish Passage Project: The Bureau of Reclamation (Reclamation) intends to issue additional funding to cooperative agreement #R11AC20087 to Henry Miller Reclamation District #2131 under the authority of catalog for domestic assistance (CFDA) 15.555, Public Law 111-11, Omnibus Public Land Management Act of 2009, Title X, Subtitle A, Part I, San Joaquin River Restoration Settlement Act; Section 10004 (b)(2). The purpose of this agreement modification allows the District to accomplish the modifications to Sack Dam and Arroyo Canal as set forth in San Joaquin River Settlement (Settlement) which was subsequently approved by the Court on October 23, 2006 requires certain modifications to Sack Dam and Arroyo Canal. The Settlement sections pertaining to these facilities include: -Paragraph 11(a)(6): Screening the Arroyo Canal water diversion immediately upstream from Sack Dam to prevent entrainment of anadromous fish; and -Paragraph 11(b)(7): Modifications at Sack Dam adequate to ensure fish passage. The modifications include environmental planning, documentation, permitting, appraisal-level engineering & feasibility design and final engineering & feasibility design of a fish screen on the Arroyo Canal and improvements to Sack Dam to allow for fish passage under a variety of flow conditions. (Refer to the Notice of Intent to Award Announcement No. R12AS20031 for additional information) A Determination by the Government not to compete this proposed financial assistance based upon Departmental Manual 505 DM 2, paragraph 2.14(B)(2) & (4) is solely within the discretion of the Government.
