Nationwide Program for National and State Background Checks for Direct Patient Access Employees of Long Term Care Facilities and Providers: Title VI, Subtitle B, Part III, Subtitle C, Section 6201 of the Affordable Care Act (ACA) directs the Secretary of Health and Human Services (HHS), to establish a nationwide program to identify efficient, effective, and economical procedures for long term care facilities and providers to conduct background checks on a statewide basis on all prospective direct patient access employees. CMS is inviting proposals from all States and U.S. territories to be considered for inclusion in this National Background Check Program which will be in effect through 2013. Federal matching funds are available to all States and U.S. territories that meet the requirements described in section 6201 of the ACA and that provide an application that is scored at 69.5 points or greater by the Federal technical panel. The national program will be evaluated by the HHS Office of Inspector General (OIG). CMS will award a technical support contract to support the States that are selected to participate in the program. This program announcement provides States with information concerning application procedures, general policy considerations, and criteria to be used in reviewing applications and selecting States.
